1. Introduction and Acceptance

Welcome to Harpenin ("App," "we," "our," "us," or "Company"). These Terms and Conditions ("Terms") govern your use of the Harpenin mobile application and all related services, features, and content offered through the App on iOS and Android platforms.

By downloading, installing, accessing, or using the Harpenin App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years old to use the Harpenin App. By using the App, you represent and warrant that you are at least 13 years old and meet all eligibility requirements. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

2.2 Account Creation

To access certain features of the App, you must create an account by providing:

• A valid email address
• A password (or using OTP-based authentication)
• Basic personal information (name, username, profile picture)

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities that occur under your account. You agree to:

• Provide accurate and truthful information
• Update your information if it changes
• Notify us immediately of any unauthorized access
• Not share your account credentials with third parties
• Not create multiple accounts or use accounts of other users

2.4 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.

3. Description of Services

3.1 Core Features

Harpenin provides the following services:

• Event Discovery: Personalized event recommendations and search functionality
• Event Experience: Access to event-specific features including timelines, activities, networking, and social interaction
• User Profiles: Ability to create and manage user profiles
• Social Features: Connection management, messaging, posts, and community interaction
• Networking: Tools to connect with other event attendees
• Real-time Updates: Live event information and notifications

3.2 Service Availability

We strive to provide continuous service availability but do not guarantee uninterrupted access. The App may experience scheduled maintenance, emergency maintenance, updates and upgrades, or service interruptions due to technical issues. We are not liable for service interruptions or data loss resulting from circumstances beyond our reasonable control.

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in ways that do not violate these Terms or infringe upon the rights of others. Specifically, you agree not to:

Content Restrictions:

• Post, upload, or share illegal, obscene, defamatory, or harassing content
• Share hate speech, discrimination, or content promoting violence
• Post sexually explicit or child-exploitative content
• Distribute spam, phishing links, or malware
• Violate intellectual property rights or copyright laws
• Share others' personal information without consent
• Impersonate others or create false identities

Technical Abuse:

• Use automated tools, bots, or scripts to access the App
• Attempt to reverse-engineer or modify the App's code
• Exploit security vulnerabilities or bugs
• Use the App to conduct DDoS attacks or similar activities
• Bypass authentication or access controls
• Scrape or crawl the App's content

Fraudulent Activity:

• Misrepresent your identity or affiliations
• Create fake events or misleading event information
• Engage in scams, fraud, or deceptive practices
• Manipulate ratings, reviews, or engagement metrics

4.2 Consequences of Violation

We may, at our discretion:

• Issue warnings
• Temporarily suspend your account
• Permanently ban you from the App
• Report violations to law enforcement
• Take legal action for damages

5. Intellectual Property Rights

5.1 App Ownership

The Harpenin App, including all code, design, graphics, audio, video, text, and compilation of content ("Content"), is the exclusive property of Harpenin and its licensors. All rights are reserved.

5.2 User-Generated Content

By uploading, posting, or sharing content on the App, you grant Harpenin a worldwide, non-exclusive, royalty-free license to use, reproduce, display, modify, create derivative works from, and distribute your content across the platform and related services. You retain ownership of your content and represent that you have the right to grant these licenses.

5.3 Content Moderation

We reserve the right to remove any user-generated content that violates these Terms, modify or delete content that is illegal or harmful, restrict access to content without prior notice, and report violations to appropriate authorities.

5.4 Trademark and Brand Guidelines

You may not use Harpenin's name, logo, or trademarks without prior written permission.

6. Limitation of Liability

6.1 Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. HARPENIN MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT, SECURITY OR SAFETY OF DATA, OR UNINTERRUPTED SERVICE.

6.2 Liability Exclusion

HARPENIN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OR DATA; BUSINESS INTERRUPTION OR LOSS OF OPPORTUNITY; DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP; OR THIRD-PARTY CONDUCT OR CONTENT.

6.3 Liability Cap

EXCEPT WHERE PROHIBITED BY LAW, HARPENIN'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM (OR $100, WHICHEVER IS LESS).

7. Indemnification

You agree to indemnify, defend, and hold harmless Harpenin, its founders, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the App
• Your user-generated content
• Your violation of any laws or third-party rights
• Disputes with other users

8. Third-Party Services and Links

8.1 Third-Party Integrations

The App may integrate with or link to third-party services including authentication providers (Google, Apple, Supabase), payment processors, social media platforms, location services, and calendar applications. Harpenin is not responsible for third-party services' accuracy, availability, or privacy practices. Use of third-party services is governed by their terms and privacy policies.

8.2 External Links

The App may contain links to external websites. Harpenin does not endorse or control external content and is not responsible for their accuracy or legality.

9. In-App Purchases and Payments

9.1 Pricing

Event registrations, premium features, and other purchases are subject to current pricing in your region, applicable taxes and fees, and platform-specific terms (Apple App Store, Google Play Store).

9.2 Billing

• Charges are processed by Apple App Store or Google Play Store
• Billing occurs at the beginning of subscription periods
• Recurring subscriptions auto-renew unless cancelled
• You can manage or cancel subscriptions through platform settings

9.3 Refund Policy

Refunds for in-app purchases are governed by Apple App Store refund policies and Google Play Store refund policies. Harpenin may issue refunds at its discretion for service failures or duplicate charges.

10. Events and Event-Related Terms

10.1 Event Discovery

The App provides access to third-party events. Harpenin:

• Does not organize or operate events
• Does not verify event organizer information
• Is not responsible for event content or accuracy
• Does not guarantee event quality or satisfaction

10.2 Event Attendance and RSVPs

By RSVPing to events through the App:

• You agree to comply with event organizer rules
• You acknowledge event details may change
• You accept potential cancellation or postponement
• You release Harpenin from responsibility for event-related injuries or incidents

10.3 Event Organizer Responsibility

Event organizers are solely responsible for event content and scheduling, attendee safety and security, compliance with local laws and regulations, and payment processing and ticketing (if applicable).

11. Community Standards and Moderation

11.1 Community Guidelines

Users agree to treat others with respect and dignity, maintain professional or appropriate conduct, report violations through the App's reporting tools, and cooperate with moderation investigations.

11.2 Reporting and Enforcement

Harpenin reserves the right to review reported content and user conduct, issue warnings or temporary suspensions, permanently ban users for severe violations, cooperate with law enforcement investigations, and share information necessary for legal compliance.

12. Privacy and Data Protection

Your use of the App is governed by our Privacy Policy. By using the App, you consent to our data collection and processing practices as outlined in the Privacy Policy.

Harpenin reserves the right to modify these Terms at any time. Changes are effective upon posting to the App. Your continued use of the App following changes constitutes acceptance of modified Terms.

We will notify you of material changes via in-app notifications, email notifications, or prominent posting within the App.

15. Dispute Resolution

15.1 Governing Law

These Terms and Conditions, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Harpenin regarding your use of the App and supersede all prior agreements and understandings.
